The Godiva Rewards Club ("Program") is open to individuals within the fifty (50) United States and District of Columbia who are at least 18 years of age or older. Void where prohibited by law. All applicable federal, state and local laws and regulations apply.
Godiva reserves the right to change and/or add Reward Benefits, at its sole discretion, at any time during the Program.
Eligible individuals can enroll in the Program online at www.godiva.com/rewards or at a Godiva Boutique located in the 50 U.S. or D.C. ("Participating Boutiques"). Please note that it is also possible to start enrollment at a Participating Boutique and complete enrollment online. A valid email address is required to receive an invitation to become a member in the Program. Eligible individuals will be required to provide a valid email address, first and last name, phone number, birth month and day and a physical address to fully complete registration enrollment. New participants who do not fully complete the enrollment process with all profile information will not be eligible to redeem any Godiva Rewards Club benefits. Members will be able to complete their profile online or in our US Godiva boutiques (as described below). Existing members who joined the Program prior to May 1, 2012 will be given the opportunity to update and complete their profile by December 31, 2012. After this date, all members who have not completed their profile will not be eligible for any Rewards Club benefits including the Free Chocolate Piece Every Month Reward until they fully complete their profile. Enrollment is deemed "complete" when an eligible individual has provided all required information to Godiva. If enrollment is initiated and completed entirely online without first obtaining a Rewards Club card from a Participating Boutique, a participant may wish to pick up a Rewards Club identification card from a Participating US Boutique. ("Rewards Club Card"). The Rewards Club Card number on the Rewards Club Card will replace any Rewards Club identification number received online. If enrollment is initiated and/or completed at a Participating Boutique, a Rewards Club Card will be provided to participant at time of completion. The Rewards Club identification card will be provided, while supplies last, at participating US Boutiques. The Rewards Club Card is not a mandatory requirement for the Program or redeeming benefits of the Program. There is a limit of one (1) enrollment registration/Rewards Club identification number/membership account per person and per email address. Multiple registrations/membership accounts established by any person or e-mail address will be void. Any attempt by any participant to obtain more than one registration/Rewards Club identification number/membership account by using multiple/different email addresses, identities, and logins, or any other methods may result in the cancellation of all associated registrations/Rewards Club identification numbers/membership accounts.
Rewards/How To Redeem A Reward:
This Program offers four (4) types of core rewards (each, a "Reward"). Members are eligible for these Rewards after they have fully completed their registration profile. (1) Free Chocolate Piece Every Month Reward: A participant is eligible to receive one (1) piece of chocolate from the eligible pieces of chocolate in the chocolate case at Participating Boutiques for free through 3/31. Beginning 4/1, a participant is eligible to receive one (1) piece of chocolate per month from the eligible pieces of chocolate case at Participating Boutiques if they meet the requirements of an active GODIVA customer as defined by GODIVA. An active GODIVA customer is defined as a GODIVA customer that has spent at least $10 in GODIVA boutiques and/or GODIVA.com during a rolling 12 month basis. GODIVA purchases outside of GODIVA boutiques and GODIVA.com do not count towards the $10 minimum. To redeem: Visit a Participating Boutique and ask a store Associate for your Free Chocolate Piece Reward. Free Chocolate Piece Rewards will be provided on a first-come, first-serve basis. Limit one (1) Free Chocolate Piece Reward per person per month. Chocolate items available as part of the Free Chocolate Piece Reward selections are at the discretion of Godiva and may change from month to month. Liquor truffles and seasonal truffles are not included. A participant is only eligible to receive one (1) Free Chocolate Piece Reward in any given month, regardless of whether such participant redeemed his Free Chocolate Piece Reward the previous month(s). Any Free Chocolate Piece Reward not redeemed by the last day of the month will be forfeited. First Free Chocolate Piece Reward will be provided at the time of enrollment. 2) Free Gift When You Spend $20 or More Reward: Make a purchase of $20 or more from a Participating Boutique, via 1-800-9-GODIVA or online at www.godiva.com (excluding tax, shipping and handling, etc. and exclusive of discounts) in one month in a single transaction to earn and redeem a Free Gift Reward in the next month. If online, member must be logged into Rewards Club account (Godiva.com/rewards) in order for an eligible transaction to qualify and a qualifying purchase made online or via 1-800-9-GODIVA will not activate the eligibility for the Free Gift Reward until the order is shipped verified—the order has been processed and shipped. If purchase is made online or via 1-800-9-GODIVA the Free Gift Rewards will be available the month following the shipment verification of the order. Approximate retail value of each Free Gift Reward will not be less than $2.95. Free Gift Rewards will be determined in Godiva’s sole discretion and may change from month to month. To redeem: Visit a Participating Boutique during the following month and ask a store Associate to redeem your Free Gift Reward. Limit one (1) Free Gift Reward per person per month, regardless of number of eligible purchases made in a given month. Any Free Gift Reward not redeemed by the last day of the following month in which it was earned will be forfeited. 3) Free Standard Shipping on One Online Order Reward: Each participant, upon complete registration, will become eligible for a one-time Free Shipping Reward. Free Shipping Reward is only redeemable on www.godiva.com and only to a single address within the U.S. Shipments to Hawaii and Alaska don’t qualify for the Free Shipping Reward. The Free Shipping Reward will be provided at time of online check out. In order to verify eligibility, participants must be signed-in to their Godiva.com/rewards account at time of check out to allow for member look-up and reward eligibility verification to occur. If visiting Godiva.com/rewards for the first time, member will complete enrollment and create user name and password. This requirement (being logged-in to Godiva.com/rewards account) applies to all members of the Godiva Chocolate Rewards Club who provided the required enrollment information at either a Participating Boutique or online. Free Shipping Reward valid on a single order to a single address and applies to a standard rate shipping method. No other shipping methods apply. Purchase cannot exceed $500 to redeem this Reward. If an order contains multiple recipients, the Free Shipping Reward will be applied to the highest dollar amount, provided such amount does not exceed $500. Reward expires one (1) year from date of completed registration in the program. 4) A Free Shipping Reward not redeemed within 365 days after completing the registration process will be forfeited. 4) Exclusive offer every month: A participant will gain access to an exclusive offer every month. The exclusive offer every month is subject to additional terms and conditions specified by Godiva and will be available online or in-store (or both). In order to verify eligibility, and redeem an exclusive offer every month, participants must present his/her Rewards Club Card (if in-store) or be signed-in to their Godiva.com/rewards account at time of check out to allow for member look-up and reward eligibility verification to occur (if online). If visiting Godiva.com/rewards for the first time, member will complete enrollment and create user name and password. This requirement (being logged-in to Godiva.com/rewards account) applies to all members of the Godiva Rewards Club who provided the required enrollment information at either a Participating Boutique or online. Released Parties (as defined below) shall not be liable for any damages, losses or delays in connection with any shipments. Shipments that are undeliverable will not be resent and such Reward shall be deemed forfeited. 5)Birthday offer is available to members during their birthday month and to members who have completed their customer profile online or in store. Completed profile includes full name, mailing address and birth day. Birthday offers can vary from month to month and will expire by the end of the month. Members cannot transfer offers to other members or carry over their birthday offer to the following month and or redeem for cash. Birthday offers can be redeemed by members only once in a given calendar year. Only one reward per member per customer. Birthday offers cannot be combined with other offers. General: A participant may be required to show the store Associate his/her Rewards Club Card to receive applicable Reward. If a participant does not have his/her Reward Club Card, he/she will be required to provide store Associate with a piece of personal information he/she provided at time of enrollment completion in order to verify membership. All Rewards redeemable in-store must be redeemed at a U.S. store only. For the purpose of this Program, a month begins on the first day of a month and ends on the last day of that month. Rewards are not cumulative. Rewards will be provided “as is” with no warranty or guarantee, either express or implied by Godiva. All Reward details are at Godiva’s sole discretion. Participants cannot transfer, substitute or redeem Rewards for cash, and Rewards have no cash value. Godiva reserves the right to substitute a Reward of comparable or greater value, at its sole discretion. Participants are responsible for all federal, state and local taxes as well as any other costs or expenses associated with Reward redemption and use not specified herein as being provided. Godiva reserves the right to verify eligibility qualifications of participants prior to redemption.
Godiva reserves the right to cancel any membership after twelve (12) calendar months of inactivity without notice. Godiva also reserves the right to cancel membership from members who do not fully complete the Program registration.
Godiva reserves the right at any time to modify, suspend or cancel the Program at any time and shall have no liability as a result of such modification, suspension or discontinuance of the Program. Any changes Godiva makes will be effective immediately on notice, which it may give either by posting the new Terms on the website or via e-mail. A participant's participation in the Program after such notice will be deemed acceptance of such changes. A participant should review the Terms periodically to ensure his/her familiarity with the most current version. A participant will always be able to tell when the version was last updated by checking the "Last Revised" date at the top of the Terms.
Rewards earned in this Program may not be used in combination with any other reward programs, offers or other promotions offered by Godiva or third parties. By participating in the Program, participants agree to release, discharge, indemnify and hold harmless Godiva, its parent, subsidiaries, affiliates, retailers, and advertising and promotion agencies, and all of their respective officers, directors, shareholders, employees and agents (collectively, "Released Parties") from any liability or damages which may arise out of participation in the Program or out of the acceptance, use, misuse or possession of any Reward or products attained through this Program.
By participating in the Program, Godiva shall have the right, but not the obligation, to use, display and publish a participant's name, likeness, biographical information and/or statements, for advertising and promotional purposes, in any and all media now or hereafter known, throughout the world in perpetuity, without further notification, permission or consideration, unless prohibited by law.
Registrations and/or Rewards generated by script, macro or other automated means are void. Released Parties are not responsible for late, lost, incomplete, delayed, inaccurate, garbled, undelivered or damaged registrations, Rewards; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or problems of any kind relating to or in connection with the Program, whether printing, typographical, technical, computer, network, human, mechanical, electronic or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Program, the processing of registrations, Rewards or in any Program-related materials. Godiva reserves the right to disqualify participants if any such participants are found tampering with or abusing any aspect of this Program, or are otherwise not in compliance with the Terms as solely determined by Godiva. In the event of a dispute regarding registrations received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of registration will be deemed to be the qualified participant and must comply with these Terms. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses.
All questions or disputes regarding the Program, including without limitation, those involving eligibility, participation, fraud and abuse will be resolved by Godiva, whose decisions shall be final and binding on participants.
Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of the Terms, or the rights and obligations of the participant and Godiva, in connection with the Program, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
